An Anambra State High Court presided over by Justice Chukwudi Okai, has turned down a motion for Stay of its judgment from Three-Man Administrator led by Chief Donatus Obi .
Justice Okai in rejecting the motion for stay reaffirmed his judgment and asked Obi to allow peace to reign in Onitsha Electronics Market by handing over to the registered Board of Trustees (BoT).
The judge also directed that the plaintiff, Ifechi Anozie, should be paid the cost awarded to him by the court and that the There -Man Administrator should stay clear from anything that has to do with the association and BoT.
He said they should restrict themselves to the collection of the State Government levies , which are tax and development levy.
Justice Okai in his judgment on July 26, 2024, had directed the three -Man Administratrator not to collect any levy except Anambra State Government levies, tax and development levy.
The Court also directed that the Administratrator should not get involved in the collection of electricity , sanitation, security, loading and off -loading levies which belong to the association.
The court also directed the Three -Man Administratrator to render account of the money they have collected from other levies except the tax and development levy to BoT , since they assumed office.
They were also asked to pay N500, 000 to the plaintiff, Ifechi Anozie which was the cost awarded in his favour by the Court.
But the three -Man Administratrator through their lawyers went back to the Court asking for a stay of the execution of its judgment.
However Justice Okai
turned down the motion saying that there was no basis to grant them stay of execution of the judgment, rather they should go and obey court order to bring peace to the market.
